10. Special Notes on Products
10a. Products for Professionals and Professional Use
Some of our range includes products intended exclusively for professional use by medical professionals (e.g. certain in vitro diagnostics – IVD).
By ordering such products, you confirm that you are authorized as a professional user to use them properly.
Use for self-testing is not permitted in these cases. The manufacturer/distributor assumes no liability for damages resulting from improper use.
10b. Products for Self-Testing
Some of our range includes products intended for self-use by laypersons (self-tests).
These products are CE-marked in vitro diagnostics for self-testing. Please read the instructions carefully and follow them exactly.
The test results do not replace a medical examination or diagnosis. In case of a positive or unclear result, consult a doctor or medical institution.
We accept no liability for damages arising from improper use.
10c. General Product Information
Always observe the instructions on the respective product packaging and the manufacturer’s user manuals.
Our products are intended solely for their designated use. We assume no liability for damages resulting from improper or non-designated use.
Nutritional or health products do not replace medical advice or treatment.
For electrical devices, the statutory warranty period of two years applies.
11. Liability
We are always liable without limitation for claims arising from damages caused by us, our legal representatives, or agents:
– in the event of injury to life, body, or health,
– in cases of intent or gross negligence,
– in the event of guaranteed commitments, where agreed,
– where the scope of the Product Liability Act applies.
In the event of a breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contractual partner may regularly rely, liability is limited to the foreseeable, typical contractual damage.
Otherwise, claims for damages are excluded.
12. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
13. Applicable Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
